Cavell Leitch has extensive experience in property law actions, being property focussed since our firm’s inception in 1923.  Our litigation team operates on a national level and partners with clients and our wider property team to deliver solutions across a wide range of matters.


Interesting legal conundrums arise within all areas of property law giving rise to disputes and where required, court proceedings.  Our litigation team has extensive experience in a range of property related litigation including:


  • Acting for landlords and tenants in commercial and residential disputes;


  • Court applications for relief against cancellation of commercial leases (forfeiture), recovery of debt and actions for possession,


  • Maori land regulatory matters and Court applications relating to Maori reservation land;


  • Sustaining and challenging caveats;


  • Charging orders and writs of sale;


  • Abandoned land applications and rating sales;


  • Mortgagee sales;


  • Applications for declarations as to legal interests in land, modification of easements and covenants;

  • Contractual disputes over the sale of land.


Recent work:


  • Obtaining orders to extinguish historical and redundant covenants;


  • Acting for landlord successfully defending application for relief against cancellation of commercial lease, and obtaining indemnity costs order against tenants.


  • Assisting a vendor obtain court orders for damages against purchaser who purported to withdraw from agreement to purchase commercial land without valid grounds;


  • Successfully obtaining declaration as to status of 999 year lease following Christchurch earthquake;
